1. Terms

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

2. Use licence

  • Permission is granted to temporarily download one copy of the materials (information or software) on Zamaya’s web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
    • modify or copy the materials;
    • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    • attempt to decompile or reverse engineer any software contained on Zamaya Fitness Resort’s web site;
    • remove any copyright or other proprietary notations from the materials; or
    • transfer the materials to another person or ‘mirror’ the materials on any other server.
  • This license shall automatically terminate if you violate any of these restrictions and may be terminated by Zamaya Fitness Resort at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy  any downloaded materials in your possession whether in electronic or printed format.

  • The materials on Zamaya Fitness Resort’s website are provided ‘as is’ . Zamaya Fitness Resort makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Zamaya Fitness Resort does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall Zamaya Fitness Resort or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Zamaya Fitness Resort’s Internet site, even if Zamaya Fitness Resort or a Zamaya Fitness Resort authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Revisions and Errors

The materials appearing on Zamaya Fitness Resort’s web site could include technical, typographical, or photographic errors. Zamaya Fitness Resort does not warrant that any of the materials on its web site are accurate, complete, or current. Zamaya Fitness Resort may make changes to the materials contained on its web site at any time without notice. Zamaya Fitness Resort does not, however, make any commitment to update the materials.

Zamaya Fitness Resort has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Zamaya Fitness Resort of the site. Use of any such linked web site is at the user’s own risk.

7. Site terms of use modifications

Zamaya Fitness Resort may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

8. Governing Law

Any claim relating to Zamaya Fitness Resort’s website shall be governed by the laws of the State of Mexico without regard to its conflict of law provisions.

General Terms and Conditions applicable to Use of a Web Site.

9. Reservations Policy:

  1. Check-in time is at 15:00; Check-out time is at 11:00. However, should your room be available before 15.00 we are happy to check you in immediately, otherwise we will store your luggage and give you towels so you can relax at the pool in the meantime or go for a training session. Late check-out requests have to be confirmed by our concierge team and are subject to room availability.
  2. Pets are not allowed on the Hotel premises.
  3. All offers are valid individually per reservation and cannot be combined.
  4. Minimum age at check-in is 16 years old. Guests accompanied by children 16 or under must book to stay in a villa and children 16 or under cannot be in or around the main resort pool. Children 16 or under cannot be in any of the training spaces at Zamaya except on the occasions when Zamaya is holding children specific classes for ages 16 and under.
    The only exception to the above policy is when there is a total buy-out of the entire resort.
  5. We recommend that all of our guests purchase Travel Insurance to cover in the eventuality of airfare cancellation especially during the hurricane season.
    We also recommend you are covered for accident, illness, medical evacuation and theft.

10. Cancelation Policy:

We are a small hotel with just a few rooms and our cancellation policies are quite strict, as we have little or no chance of reselling rooms in case you cancel last minute. So if you wish to make changes in your travel plans, please let us know at your earliest convenience so we will not have to charge you! For individual reservations only. (For group cancellations, please contact our booking office or your designated group planner).

Travel Insurance: we strongly recommend our guests purchase a travel insurance to avoid incurring in last minute cancellation fees.

  1. There is no refund for cancellations. (Not valid for group bookings and this needs to be discussed with your group planner).
  2. There are no modifications or rescheduling to confirmed bookings.  
  3. Any changes to your confirmed reservation must be sent by a written request to info@zamaya.com and must be confirmed by email from our reservation staff. Any changes requested after the first confirmation email are subject to the Hotel availability. (Changes made by phone and with no email verification are not valid)
  4. There are no refunds or credits for flight cancellations. Please see our recommendation for Travel Insurance to avoid any inconveniences with regards to flight delays or other situations. The Hotel will not be covering for any monetary loss due to the above. 
  5. No refunds are issued for checking out before agreed date or no shows. 
  6. Reservations are non-transferable.
  7. UNAVOIDABLE AND EXTRAORDINARY CIRCUMSTANCES: Zamaya Fitness Resort will not be liable or pay you compensation if their contractual obligations to you are affected by extraordinary and unavoidable circumstances. “Extraordinary and unavoidable circumstances” means any event beyond Zamaya Fitness Resort’s control, the consequences of which could not have been avoided, even if all reasonable measures had been taken. Examples include, warfare, acts of terrorism (or the threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease or pandemic, natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the Accommodation or remain at the Accommodation, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, fire, chemical or biological disaster, unavoidable technical problems with transport, air traffic control strikes, or flight cancellations.

11. Liability Policy

For individual reservations only. For group reservations please contact our booking office.

The Hotel is not liable for loss of personal items that are left in the room, or for losses incurred on hotel premises. Please use the safe in the room for the storage of valuables.

Any delays or cancellation in the event of illness during a vacation, or early check out; hospital and medical expenses are the traveler’s responsibility. Please see our recommendation for Travel Insurance to avoid any inconveniences.

The Hotel is not liable for any other costs, evacuation or inconveniences caused by a tropical storm or hurricane or of any event which lies beyond the Hotels’ or the supplier’s reasonable control, including but not limited to acts of Nature (e.g. hurricanes, mudslides, flooding and earthquakes.). We recommend travel insurance to avoid any inconveniences with regards to the above situations.

In case of calamities of force majeure or national emergencies in Mexico and that do not depend on the Hotel, there is no refund, but payment for reservations will be applied to a new reservation with change of dates; arrivals under 30 days are subject to a fee for re-scheduling, please contact our booking team at info@zamaya.com. This policy does NOT apply to group reservations. We recommend travel insurance to avoid any inconveniences with regards to the above situations
